OUR FEES

1. H.S.T.

All legal fees and certain disbursements are subject to the Harmonized Sales Tax (H.S.T.).

   

2. DISBURSEMENTS

In addition to the fees quoted below you will be charged the actual out of pocket disbursements we pay on your behalf. The filing and search fees charged by the various levels of government have increased significantly. We will give you an estimate of the disbursements upon request.

   

3. WILLS

 
a) Individual wills which do not involve complex drafting $350
b) Simple wills for spouses (two wills) $400
c) Wills requiring complex drafting at hourly rates
d) Codicil at hourly rates

e) Codicil for spouses
at hourly rates
f) Power of Attorney  
Consultation, preparation and execution of a single Power of Attorney (financial or personal care) $250
Consultation, preparation and execution of Powers of Attorney (financial or personal care) for spouses $300

g) Single Power of Attorney (financial or personal care) prepared at the same time as the consultation for Will

h) Powers of Attorney (financial or personal care) done for spouses at the same time as consultation of Will

4. ESTATES

 

Estate work is billed on an hourly basis.

If the firm does part of the executor's work we also charge part of the executor's fees. The court usually sets the executor's fees at about 5% of the value of the estate.

Accounts will be reviewed individually by the lawyer responsible and the account may be varied depending upon the amount of time devoted to the file by the lawyer and the estate clerk and the complexity of the estate.

 

5. INCORPORATIONS

 

a) Incorporation of a private company with no more than three shareholders, where the company has a number name.

c) Shareholders agreements are based on the time required to draft the agreement at the applicable hourly rate.  
d) Annual meeting resolutions

6. RESIDENTIAL REAL ESTATE

 
The fees quoted below are subject to review individually by the lawyer responsible and the account may vary depending upon the amount of time devoted to the file by the lawyer and the support staff and the complexity of the matter.
Preparation of Agreement of Purchase and Sale at hourly rate

a) Purchase of residential land

Land Transfer Tax is payable to the Provincial Government, on the purchase price at the rate of:

1/2 of 1% up to $55,000
1% from $55,000 to $250,000
1.5% from $250,000 to $400,000 and
2% on the remaining

Out of pocket Disbursements usually range from $350 to $550 on the purchase of real estate.
 
b) Condominiums - add $100 on each of the price categories in the residential purchase tariff
   
The above fees apply to purchase of residential land and include the purchase of vacant land as well as of a residential house. The above fee also includes first mortgage financing on the same property related to the transaction.
 

SALES

 
a) Sale of residential land

Out of pocket Disbursements usually range from $150 to $250 on the sale real estate.

The above fees apply to vacant land as well as property on which there is a building and include the discharge of the existing first mortgage.

 

MORTGAGES

 
Done alone and not in conjunction with a purchase:  
a) New mortgage alone where we have not been on title before whether or not that mortgage is collateral to the transaction or is a stand alone transaction. Same as Purchase Schedule

b) The refinance of mortgage where we have acted for the client to purchase or previously finance the same property:

Upon request, fees will be quoted by the lawyer responsible and will be based on the complexity of the matter and an estimate of the hourly time required to be put into the file by the lawyer and the support staff. The fees include financing related to the transaction.

SALES

 
a) Sale of a commercial business with or without real estate  
Upon request, fees will be individually quoted by the lawyer responsible and will be based on the complexity and an estimate of the hourly time required to be put into the file by the lawyer and the support staff.
   

SECURITY DOCUMENTATION

 

a) Security documentation for borrowing by a commercial business with or without real estate

 
Upon request, fees will be individually quoted by the lawyer responsible and will be based on the complexity and an estimate of the hourly time required to be put into the file by the lawyer and the support staff.
 

8. LITIGATION

CRIMINAL LAW FEES

Most criminal matters are billed on a block fee basis depending upon many factors including the complexity of the case, the seriousness of the charge and the expected length of the proceeding.  The block fee will be quoted at the outset and is to be paid in full at that time.  The Firm also accepts Legal Aid Certificates for some charges.
